1. About Dreamloom

These draft Terms of Use apply to the Dreamloom app, website and related creative services (the “Service”). The provider is David Stein. The effective date will be [CONFIRM: EFFECTIVE_DATE].

Dreamloom lets families create creatures from artwork, use saved characters in worlds, AR and games, and create digital Dreambooks. Dreambooks are the keepsakes in the launch scope. Physical books, ordering, cards, passports and care features are not included in this launch offer.

2. Eligibility and family use

The account holder must be an adult able to enter this agreement and must have authority to manage the information and use of any child profiles they create. Children use the Service within that adult-managed family arrangement, with appropriate supervision.

A selected age range helps tailor a book; it does not independently verify a person’s age or guarantee every output will suit that child. Any additional child-consent or eligibility requirements for a launch country must be satisfied before the Service is offered there.

Before publication

Confirm the contractual adult-age threshold and launch regions. The policy does not turn payment confirmation or an email code into universal parental-consent verification.

3. Accounts and access

Provide accurate adult account details, keep access to your email and devices secure, and tell us promptly about suspected unauthorised account use. Do not share credentials with unrelated households or misrepresent your authority over a child profile.

We will take reasonable steps within our control to protect account access. Your responsibility for activity is subject to applicable law and the circumstances; these Terms do not make you automatically liable for losses caused by our own security failures.

4. Dreamloom Family subscriptions

Dreamloom Family is one paid family subscription with two billing choices. Both include the same unlimited creature and Dreambook creation features. There are no monthly creation quotas, creation-credit balances, top-up packs or rollover rules.

The annual offer saves A$19.40 compared with twelve A$7.95 payments. “Save 20%” is a rounded-down description of that comparison, not a separate discount applied at checkout.

When available, purchases are made through Apple. The Apple purchase sheet displays the actual price, currency, subscription duration and applicable tax treatment for your storefront. Payment is charged to your Apple Account on confirmation. A subscription renews automatically for its selected period unless cancelled before renewal through Apple’s subscription controls. Your Apple subscription screen shows its relevant renewal or expiry date.

Unlimited describes the number of new creatures and Dreambooks for an active subscriber. It does not remove safety checks, ordinary processing queues, technical file requirements or protections against duplicate requests, compromised accounts and abusive automation. Those safeguards must not be used as hidden creation quotas.

A Dreamloom family account is not the same as enabling Apple Family Sharing across separate accounts. Do not assume an Apple Family Sharing entitlement unless it is expressly supported in the actual product setup.

5. Cancellation, refunds, trials and pricing

Manage or cancel renewal through Apple’s subscription settings. Cancelling renewal normally leaves the existing paid entitlement until the expiry shown by Apple; refunds, revocations or other verified changes may affect it. Deleting the app, archiving a profile or asking Dreamloom to delete an account does not by itself cancel Apple billing.

For an App Store charge, use Apple’s refund-request process. Refund eligibility and decisions are assessed by Apple, without removing any rights or remedies you have under applicable consumer law. Contact Dreamloom about a service problem as well.

No free trial, introductory offer or lifetime entitlement is promised by this draft. Future price changes must follow applicable law and Apple’s notice/consent processes. We will not retroactively substitute a new price for an already completed billing period or treat an unspecified future plan as part of today’s offer.

6. Your artwork and generated content

You and the relevant rights holders retain existing rights in artwork and other material supplied to Dreamloom (“User Content”). Upload only content you have the right and authority to use, including appropriate authority for a child’s artwork. Do not include other people’s private information unnecessarily.

You permit us and the service providers we use to host, copy, transmit, process, adapt and display User Content only as reasonably necessary to provide your requested features, protect the Service and meet legal obligations. This is not a transfer of ownership or a general licence to advertise with your family’s content.

AI-assisted outputs can resemble other outputs and may contain errors. We do not promise that every output is unique, exclusively yours or independently eligible for copyright. Nothing here removes rights that already exist in your original artwork.

Before publication

Confirm the final limited content licence, provider contracts and any separate improvement/training uses with legal counsel. The former broad “improve the service” permission is intentionally not treated as blanket permission for unrelated model training or publicity.

7. Acceptable use and safe play

Do not upload unlawful, exploitative, abusive or infringing material; seek to expose private family data; evade access controls; introduce malicious code; interfere with the Service; or use automated request patterns designed to cause harm. Report concerning content or a safety issue through the Support contact.

AR and movement-based games need a suitable clear space and adult supervision. Stay aware of real obstacles, other people, pets and your surroundings. Stop use when it becomes unsafe or uncomfortable. Digital creatures do not remove real-world hazards.

Safety and service-protection measures must be proportionate to actual risk and are separate from the unlimited creation offer.

8. Dreamloom intellectual property

Dreamloom software, branding, interface designs and original service materials are owned by or licensed to the operator, except for User Content and third-party materials. We grant the access needed to use the Service as offered, not ownership of its software or brand.

Do not redistribute or exploit the software or branding without permission, except where a licence or mandatory law allows it. Open-source components remain subject to their own applicable licences.

9. Availability and service changes

Some features depend on internet access, compatible hardware and external processing services. We aim to provide the Service with reasonable care and skill, but cannot promise that every request will be immediate or that there will never be downtime.

We may make reasonable maintenance, safety and feature changes. For a material adverse change to paid functionality, we will provide appropriate notice and any cancellation, refund or other remedy required by law and the applicable purchase terms. This clause is not permission to remove paid benefits without regard to your rights.

10. Privacy and data choices

The Privacy Policy explains handling of account details, child profiles, uploaded artwork, AI requests, saved media, transactions and support information. Reading or accepting these Terms does not substitute for a separate notice or consent where one is required.

Available export and account-data request tools help manage family information. Archiving, requesting deletion, completing deletion and expiring backups are different steps. Do not assume any one of them automatically performs the others.

11. Apple and other third-party services

Apple supplies the App Store and payment platform. AI, image-processing, hosting and communication providers support parts of Dreamloom. Their services and applicable terms may affect availability or processing, but this does not remove Dreamloom’s obligations to you under law or these Terms.

To the extent required for the iOS app licence: this agreement is between you and the Dreamloom operator, not Apple; Dreamloom is responsible for its app and support. Apple is not obliged to provide maintenance or support. Apple and its subsidiaries may enforce the applicable iOS licence terms as third-party beneficiaries. Mandatory Apple licence provisions and consumer rights are not excluded.

Before publication

Review the final iOS licence wording against Apple’s applicable developer/licence requirements. Do not paste this website document into App Store Connect as a custom EULA without a separate licence review.

12. Suspension, closure and termination

We may restrict access where reasonably necessary to address a substantiated Terms breach, safety issue, security incident or legal requirement. Where practical and safe, we will explain the reason, give an opportunity to correct the issue and provide a support route for review.

Action should be proportionate and no longer than reasonably needed. Paid-service remedies and non-excludable rights remain available. You may stop using Dreamloom and cancel Apple renewal at any time; a separate request is needed for account-data deletion.

13. AI output and service limitations

Generated stories, reading activities, maths content and creature interpretation may be inaccurate, unsuitable in a particular context or different from what you expected. Parent review is important. Safety prompts and moderation reduce some risks but do not guarantee every output is correct or appropriate.

Dreamloom is a creative family experience, not a substitute for a teacher, professional assessment or advice. We do not promise measurable educational outcomes. Technical limitations do not reduce any applicable obligation to provide the Service with reasonable care and skill.

14. Consumer rights and liability

Nothing in these Terms excludes, restricts or modifies a consumer guarantee, right or remedy that cannot lawfully be excluded, including applicable rights under the Australian Consumer Law. Depending on the circumstances, those rights can include remedies for services that do not meet required standards.

We do not use a blanket “no refunds” rule, an automatic disclaimer for all losses, or a liability cap that purports to override those rights. Responsibility for a loss will depend on applicable law, the relevant breach, causation and the circumstances.

Before publication

A lawyer should review the final allocation of liability for the actual operator and launch markets. The preceding generic draft’s broad exclusions have not been carried forward as an unquestioned consumer term.

15. Responsibility for misuse

You are responsible for your own unlawful or deliberately harmful conduct to the extent provided by law. We may pursue appropriate remedies where misuse causes loss. These Terms do not impose an unlimited indemnity on a parent for every third-party allegation, a child’s every action or losses caused by our own wrongdoing.

Before publication

Any proposed indemnity requires a specific, proportionate legal review. A generic blanket indemnity has deliberately not been included.

16. Governing law

Proposed for owner/legal confirmation: these Terms are governed by the laws of New South Wales, Australia, with non-exclusive jurisdiction in its courts, except to the extent mandatory consumer or other local laws provide otherwise. This clause does not remove a protected right to bring a claim in another appropriate forum.

17. Updates to these Terms

We may update these Terms for reasonable operational, legal or product reasons. The effective date and version will be recorded. Material changes will be notified appropriately and applied prospectively, subject to mandatory law and your existing paid rights.

Any new use of personal information requiring consent must follow its own notice/consent process. Updating these Terms alone is not authority for that new use.
